What is the OECD BEPS framework?

BEPS (Base Erosion and Profit Shifting) is an OECD/G20 initiative comprising 15 actions designed to prevent multinational enterprises from artificially shifting profits to low-tax jurisdictions. It establishes international standards for transfer pricing, country-by-country reporting, and tax treaty provisions that UK multinationals must comply with.

For UK multinationals, the most impactful actions are typically Action 13 (Country-by-Country Reporting and transfer pricing documentation), Action 5 (harmful tax practices), Action 6 (treaty abuse prevention), and Actions 8-10 (transfer pricing alignment with value creation). Pillar 2 (global minimum tax) is also now a major compliance priority.

Pillar 2 is an extension of the BEPS framework, often called ‘BEPS 2.0’. While the original 15 BEPS actions focused on profit shifting, Pillar 2 introduces a 15% global minimum effective tax rate for multinationals with consolidated revenue over EUR 750 million. The UK enacted Pillar 2 through the Multinational Top-up Tax from 1 January 2024.

The OECD regularly updates BEPS guidance, with transfer pricing guidelines revised periodically (most recently in 2022) and Pillar 2 implementation guidance being released on an ongoing basis.
